Terms of Service

These Terms of Service ("Terms") govern the pool cleaning, maintenance, and repair services provided by Halcyon Pool Co. ("Halcyon," "we," "us," or "our") to residential customers in Baton Rouge, Louisiana and surrounding parishes. By scheduling or accepting service from Halcyon, you ("you," "customer," or "property owner") agree to these Terms.
1. Description of services
Halcyon provides recurring weekly and bi-weekly pool cleaning and chemical maintenance, equipment repair (including pumps, filters, and heaters), green-to-clean recovery service, seasonal pool openings and closings, and filter cleanings for residential swimming pools. Specific services, frequency, and pricing are set out in your service agreement or order confirmation.
2. Property access and gate entry
You are responsible for providing safe, clear, and unobstructed access to your pool and pool equipment on each scheduled service date. This includes keeping gates unlocked or providing a working access code, keeping walkways clear of tripping hazards, restraining or securing pets away from the pool area and equipment during the scheduled service window, and disclosing any hazards on the property (loose fencing, aggressive animals, unstable footing, exposed wiring, and the like).
If a technician cannot safely access your pool because a gate is locked without a working code, a pet is loose in the service area, or another obstruction is present, we may skip the visit and it will count as your scheduled visit for that period, or we may reschedule at our discretion. Halcyon is not liable for algae growth, water imbalance, equipment issues, or other consequences that result from a missed visit caused by blocked access. Repeated access problems may result in an additional trip charge or, at our discretion, termination of service under Section 12.
3. Water chemistry and swimmer safety
We test and balance your pool's water chemistry at each visit according to industry-standard guidelines. However, pool water chemistry can change quickly between visits due to factors outside our control, including weather (heat, heavy rain, and sunlight all affect chlorine and pH levels), bather load, debris, and chemicals or products added by anyone other than our technicians. Because of this, Halcyon does not guarantee that your pool will remain algae-free, clear, or perfectly balanced at all times between scheduled visits.
If you add your own chemicals, tablets, or algaecides between our visits, please tell us, since this can interact with the products we use and affect the accuracy of our chemical dosing. We are not responsible for water quality issues caused by chemicals added by the customer, household members, or third parties.
For your safety, do not swim immediately after certain treatments. As a general guideline, wait at least 20 to 30 minutes after routine chemical additions before swimming, and follow any specific guidance our technician leaves after a shock treatment, algaecide application, or similar treatment, which may require a longer wait (in some cases several hours) before the pool is safe to use. If in doubt, ask your technician or call our office before swimming.
4. Chemical handling and storage
Our technicians are trained in the safe handling, transport, and application of pool chemicals, including chlorine products, muriatic acid, and algaecides. If Halcyon stores any chemicals or supplies on your property between visits (for example, in a pool equipment shed you've designated), you agree to keep that storage area secured from children, pets, and unauthorized access, and to notify us of any leak, spill, or damage to stored chemicals as soon as you become aware of it. Do not mix any chemicals we leave on-site with other pool products without checking with us first, since combining certain pool chemicals can be hazardous.
5. Equipment: pre-existing conditions, age, and repairs
Many of the pools we service have existing pumps, filters, heaters, salt cells, automation systems, and plumbing that Halcyon did not install and does not warrant. Pool equipment has a limited service life, and age, prior installation quality, prior repairs by others, and ordinary wear can cause a component to fail at any time, including during or shortly after a routine service visit.
Halcyon is not liable for the failure of equipment that is old, worn, was not installed by us, or that fails due to conditions that existed before our service began. When our technicians notice signs of wear, damage, or an approaching failure, we will point it out and, where appropriate, provide a written estimate. We will not perform repair work beyond routine maintenance without your authorization. Verbal or written approval of a written estimate is required before we begin repair work, except in cases where you have specifically authorized us in advance to make time-sensitive repairs up to a stated dollar amount without separate approval.
Estimates are based on a visual inspection and the information available at the time. Additional issues found once a repair is underway (common with older or previously repaired equipment) may require a revised estimate, which we will discuss with you before continuing.
6. Property damage: standard of care and limitations
Halcyon's technicians are trained to use reasonable care while working on your property. Despite that care, incidental damage can occur, particularly to aging decking, older plumbing connections, brittle plastic fittings, or equipment that was already compromised before our visit. Halcyon will repair or reimburse for damage that our technicians directly and negligently cause to your property, up to the limitations described in Section 13.
Halcyon is not responsible for damage caused by pre-existing conditions, ordinary wear and tear, the failure of equipment we did not install, acts of nature, or issues that were already present but not visible or disclosed before we began work. If you believe our technician caused damage to your property, please report it to our office within 5 business days of the visit in question, with photos if available. Prompt reporting helps us investigate accurately and resolve the issue fairly. Claims reported after this window may be harder for us to verify and may be denied on that basis.
7. Weather and unsafe conditions
For the safety of our technicians and your property, Halcyon reserves the right to skip, delay, or reschedule a visit due to lightning, severe storms, flooding, freezing temperatures, or any condition we reasonably believe makes it unsafe to service your pool. When a visit is skipped for weather or safety reasons, we will make a reasonable effort to reschedule within a few business days. Halcyon is not liable for water quality changes or equipment issues that result from a weather-related delay.
8. Scheduling, skipped visits, and recurring service billing
Recurring service plans (weekly or bi-weekly) bill on a regular cycle as described in your service agreement, whether billed per visit, monthly, or on another interval we've agreed to. Your plan continues automatically at that frequency and price until you change or cancel it, subject to any seasonal adjustments or pricing changes we communicate to you in advance.
If we skip a visit for reasons outside your control (weather, our own scheduling issue), we will not bill you for that visit, or we will apply a credit toward your next invoice. If a visit is skipped because access was blocked (Section 2) or because of unsafe conditions on your property, it still counts as a completed visit for billing purposes.
9. Pausing or cancelling service
You may pause or cancel recurring service at any time by contacting our office or through your customer portal. We ask for at least 5 business days' notice before your next scheduled visit so we can adjust our route and billing accordingly. Cancelling or pausing service does not entitle you to a refund for visits already completed. If you resume service after a pause, your pool may require an additional assessment, and in some cases a green-to-clean recovery service, if it was not maintained during the pause.
10. Payment terms
Invoices are sent electronically with a secure payment link and are due upon receipt, unless we've agreed to different terms in writing for your account. Recurring plan customers may set up automatic payment through the payment link on file, which we recommend to avoid service interruption.
11. Late payment, returned payments, and service suspension
If an invoice is not paid within 10 days of the due date, we may apply a late fee as disclosed in your service agreement or on the invoice, and we may suspend future visits until your account is brought current. A returned or declined payment may also result in a returned-payment fee. Halcyon is not liable for algae growth, water imbalance, or equipment issues that occur while service is suspended for nonpayment. We will make reasonable efforts to notify you before suspending service and will resume regular visits promptly once your account is current.
12. Right to refuse or terminate service
Halcyon may decline to perform, pause, or terminate service if we determine that a property presents an ongoing safety hazard to our technicians (aggressive animals, unsafe structures, threatening behavior, hazardous materials, and so on), if access issues continue after notice, if payment remains delinquent, or for any other reasonable business reason, with notice to the customer where practical.
13. Limitation of liability
To the fullest extent allowed by Louisiana law, Halcyon's total liability for any claim arising from our services, whether based on contract, negligence, or any other legal theory, is limited to the amount you paid Halcyon for service in the three months before the event giving rise to the claim, or the cost to repair the specific damage directly and negligently caused by our technicians, whichever is greater. Halcyon is not liable for indirect, incidental, or consequential damages, including lost use of your pool, algae or water quality issues arising between visits, or the failure of equipment we did not install and do not maintain under a separate written warranty.
14. Indemnification
You agree to hold Halcyon harmless from claims, damages, or costs arising from inaccurate access information you provide (such as an outdated gate code or an undisclosed hazard), unauthorized chemicals or products added to the pool by anyone other than our technicians, or your failure to follow posted safety guidance (such as swim-wait times after treatment), except to the extent any such claim results from Halcyon's own negligence.
15. Licensing and regulatory note
Louisiana requires state contractor licensing, administered by the Louisiana State Licensing Board for Contractors (LSLBC), for certain construction and repair work above a dollar threshold that is periodically updated by the board, and the LSLBC maintains specific license classifications that can apply to pool-related construction and repair work. Halcyon Pool Co. maintains any state or local licenses required for the scope of work it performs and complies with applicable Louisiana and parish requirements. If you have questions about whether a specific repair falls under additional licensing or permitting requirements, ask us and we will let you know, or you may confirm directly with the LSLBC.
16. Governing law and dispute resolution
These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles. Any dispute arising from these Terms or our services will be handled in the state or parish courts located in East Baton Rouge Parish, Louisiana, unless the parties agree in writing to another method, such as mediation. Before filing a claim, we ask that you first contact our office so we have the chance to resolve the issue directly.
17. Changes to these terms
We may update these Terms from time to time to reflect changes in our services, pricing structure, or applicable law. The version posted on our website is the current version. Continuing to use Halcyon's services after an update constitutes acceptance of the revised Terms.
